New Jersey is known as a no-fault state. Essentially when you get into an accident your insurance company May cover for any medical expenses outside of who caused the crash. Also, keep in mind that you do have a right to sue in the state of New Jersey.
There are two ways that you can’t sue for damages if you or a family member is or were damaged in a car accident that did not happen because of you.
- Limited rights: this means you can sue how severe the injury is. Essentially in cases like this it would mean death, loss of a body part.
- Unlimited right: this basically means you can sue for no matter what damages or injuries you’ve incurred.
Keep in mind that these are additional options on to your policy, and if you were to go to a route where you’re able to have limited rights to sue the opposing party your insurance premium will go up quite a bit.
